Terms & Conditions

These Terms & Conditions apply to all services and products provided by VIVE Cooking School, including but not limited to recreational public and private cooking class events, venue hire, e-Gift cards, e-commerce products, and privacy-related matters.

Definitions

VIVE Cooking School (VIVE, We, Our, Licensor):

Refers to VIVE Cooking School Pty Ltd, ABN 69 608 649 109

Customer (they, you, students, participants, customers, Licensee):

Refers to any individual or entity engaging with VIVE Cooking School’s services or products.

General Terms

  1. Changes to Terms & Conditions: VIVE reserves the right to amend these Terms & Conditions without prior notice. Changes will take effect immediately upon publication on our website.
  2. Acceptance of Terms: By booking a class, booking a private event class, hiring the venue, purchasing a product, or engaging in any other service provided by VIVE, you agree to comply with these Terms & Conditions.
  3. Governing Law: These Terms & Conditions are governed by the laws of New South Wales, Australia.
  4. Communication: All official communications, including cancellation requests, must be sent to VIVE via email at order@vivecookingschool.theteamserver.com
  5. Liability Disclaimer: While we take all reasonable steps to ensure a safe and enjoyable experience, participation in classes, events, or other activities is at your own risk.

1. Recreational Cooking Class Public Event

Definition

A Recreational Cooking Class Public Event refers to any cooking class hosted by VIVE Cooking School, where tickets are available for individual purchase via the VIVE website (www.vivecookingschool.theteamserver.com) or other third party platforms.

General Terms

  • Start Time: Classes begin promptly. Guests are advised to arrive at least 10 minutes before the scheduled start time. Latecomers are responsible for catching up without disrupting the class.
  • Health Responsibility: Participants must not attend if they have been unwell within 48 hours before the class (e.g., flu, cold, vomiting). VIVE reserves the right to refuse entry without a refund if a participant shows signs of serious illness.
  • Attire: Closed-toe shoes are required for safety. Comfortable clothing is recommended, as the classes are hands-on and participants will be on their feet.
  • Recording: Classes may be recorded or broadcast live within VIVE or The Cannery premises for promotional purposes. Guests who do not wish to appear in such materials should inform staff in advance. Efforts will be made to exclude them from published content.
  • Smoke-Free Zone: Smoking and vaping are strictly prohibited on the premises.
  • Behavioural Standards: VIVE reserves the right to refuse entry or remove participants whose behaviour is deemed unsafe or disruptive.
  • Tickets: Tickets must be paid in full to confirm booking. A maximum of 8 tickets per booking is allowed for public events. For larger groups, private event bookings are necessary.
  • Release of Liability: Participants release VIVE from any liability for personal injury or damage incurred while attending the class.
  • Personal Property: VIVE is not responsible for lost or damaged items. Items left behind must be collected within 7 days.
  • Damage to Property: Participant(s) will be held financially responsible for any damage caused to the premises or equipment during the booking session period. Any damages must be reported immediately to VIVE Cooking School.
  • Alcohol Policy: VIVE Cooking School is fully licensed. BYO is not permitted. Alcoholic beverages can be purchased after the first cooking demonstration.
  • Website Use: Use of VIVE’s website is subject to these terms.

Children Attending Recreational Cooking Class Public Event

All adult classes are for participants aged 16 and above. Children aged 12 to 15 years old who are at least 1.3m tall can attend our adult classes, provided they are accompanied by a responsible adult (ratio 1 child: 1 adult). Both child and guardian require a ticket each.

Please inform us in the note section (number of children & their ages) when making your booking at the checkout page. For the safety of all students, we reserve the right to refuse entry if these conditions are not met.

All junior classes are strictly for children aged 7 years old till 15 years old inclusive and must be at least 1.3 m tall. For the safety of our students, we reserve the right to refuse entry if these conditions are not met.

Cancellation Policy for Recreational Cooking Class Public Event

Customer Cancellation

  • More than 48 hours before class: Cancellations are accepted via email only. A credit note valid for 6 months will be issued.
  • Within 48 hours of the class: Cancellations will receive a 50% credit note valid for 6 months.
  • No-shows or cancellations after the class start: Tickets are forfeited, and no refunds or credit notes will be issued.

If you need to cancel your booking, please notify us immediately by email at order@vivecookingschool.theteamserver.com, quoting your booking number and the number of ticket(s) you need to cancel. Phone or Voicemail cancellations notification will not be accepted.

We do our best to help, but the earlier we know about your cancellation, the less impact it has on our operations, and it will limit potential costs for both sides.

Cancellation by VIVE Cooking School

If VIVE Cooking School needs to cancel your booking, we will take every effort to notify you as soon as we can.

If you booked using a credit card, you will have two options:

  1. You could choose a refund of the amount paid via credit card.
  2. You could choose a credit note to reschedule your ticket(s) at another date and time.

If you booked using – partially or fully – a Gift Card Code, a Coupon Code, or a Credit Note Code, we will re-instate the value of your gift card code, coupon code, or credit note code according to the value in the form of a credit note code.

Potential reasons for VIVE to cancel a class include but are not limited to:

  1. Low attendance: If we don’t reach a minimum of 6 attendees for a given class, VIVE reserves the right to cancel and reschedule the session.
  2. Unforeseen circumstances: Circumstances that are beyond our control, and impact our ability to deliver the VIVE Cooking Class experience safely and adequately. For example, a power outage will prevent our ability to deliver the VIVE Cooking Class experience safely. Another example is if our chef Instructor scheduled for a class is not able to deliver due to unforeseen circumstances and we are unable to find another chef instructor replacement in time.

Limited responsibility

VIVE Cooking School is not liable for any costs incurred beyond the cost of the ticket(s) if a class is cancelled.

Credit Note

Credit notes are non-refundable, non-transferable, and not redeemable for cash.

Credit notes expire 6 months from issuance.

Credit notes cannot be applied to private events or gift card purchases.

Allergy Policy

As a fully operational recreational cooking school, we utilise nuts, wheat, dairy, sugar and other raw natural ingredients and whole foods on our premises every day. Therefore VIVE Cooking School cannot guarantee that our venue is free of, but not limited to, traces of nuts, wheat, dairy, sugar, and other allergens and therefore cannot eliminate any risk of cross-contamination.

  • Allergen Risk: VIVE cannot guarantee an allergen-free environment.
  • Notification: Notify VIVE by email at order@vivecookingschool.theteamserver.com of any allergies at least 5 days prior to the class.
  • Indemnity Form: Depending on the severity, an indemnity form may be required. If the form is required, you must return the form filled and signed prior to attending an event in our venue.

VIVE reserves the right to refuse entry to a cooking class or a private event on the day (with no refund or class transfer available) if the student has a known allergy and hasn’t informed us prior to attending the class or hasn’t filled in the indemnity form.

2. Recreational Cooking Class For Private Event

Definition

A Recreational Cooking Class For Private Event refers to any private event hosted by VIVE Cooking School. This includes, but is not limited to, Team Building Events, Private Cooking Parties, and Children’s Private Cooking Parties.

Booking Terms for Private Events

Deposit & Payment:

  • A deposit equivalent to the minimum spend (peak or off-peak) is required to secure your booking.
  • All invoices must be paid in full before the event date.

Cancellation & Rescheduling by Customer:

  • Within 6 weeks of the event: The minimum spend deposit is non-refundable.
  • Within 2 weeks of the event: No refunds will be issued for a reduction in attendee numbers.

General Terms

  • Recording: Classes may be recorded or broadcast live for promotional purposes. If you prefer not to appear in these recordings, inform VIVE staff in advance. Efforts will be made to exclude you from published materials.
  • Smoke-Free Zone: Smoking and vaping are prohibited on the premises.
  • Behavioural Standards: VIVE reserves the right to refuse entry or remove participants whose behaviour is unsafe or disruptive.
  • Release of Liability: Participants release VIVE from any liability for personal injury or damage incurred during the event.
  • Personal Property: VIVE is not responsible for lost or damaged personal items. Items left behind must be collected within 7 days.
  • Damage to Property: Participant(s)/company will be held financially responsible for any damage caused to the premises or equipment during the booking session period.

  • Website Use: The use of VIVE’s website is subject to these terms and conditions.

Children at Private Events

Adult Classes:

  • Participants must be aged 16 or older.
  • Children aged 12–15 who are at least 1.3m tall may attend if accompanied by a responsible adult (1:1 ratio).

Private Kids’ Parties:

  • Exclusively for children aged 7–15 (inclusive) and must be at least 1.3 m tall.For the safety of our students, we reserve the right to refuse entry if these conditions are not met.
  • No adults, apart from VIVE staff, are permitted on the premises during kids’ sessions.

Cancellation Policy for Recreational Cooking Class Private Event

Cancellation by Customer:

  • Within 6 weeks of the event: No refund of the minimum spend.
  • Within 2 weeks of the event: No refund for decreases in attendee numbers.
  • Cancellation requests must be submitted in writing via email to event@vivecookingschool.theteamserver.com. Phone or voicemail notifications will not be accepted.

Cancellation by VIVE Cooking School:

  • VIVE will issue you a credit note to reschedule the event.

Limited responsibility

VIVE Cooking School is not liable for any costs incurred beyond the cost of the event fee if a class is cancelled. (e.g., travel or accommodation).

Credit Note:

Credit notes are non-refundable, non-transferable, and cannot be redeemed for cash.

Credit notes for private events are valid for 12 months from issuance and can only be used to book another private event.

3. Venue Hire

Definition

Venue Hire refers to the temporary use of VIVE Cooking School’s premises for private events, team-building activities, or other approved purposes.

Booking Terms

  1. Deposit & Payment:
    • A deposit is required to secure your booking.
    • Full payment must be received no later than 7 working days before the event date.
  2. Use of Venue:
    • The premises may only be used for the agreed purpose during the specified time.
    • The venue must be left clean and in its original condition.
  3. Changes to Booking:
    • Requests to reschedule are subject to availability and may incur an administrative fee.

Cancellation Policy

  1. By the Licensee: Cancellations within 10 weeks of the event date will forfeit the deposit.

Insurance & Liability

  1. Public Liability Insurance:
    • Clients hosting events must provide valid public liability insurance coverage of at least $20 million.
  2. Damage & Repairs:
    • Clients are responsible for any damages caused to the premises or equipment.
    • Any damages must be reported immediately to VIVE.
  3. Liability Disclaimer:
    • VIVE is not liable for loss, damage, or injury to attendees or their property, except where caused by VIVE’s negligence.

General Rules

  1. Standing on kitchen benches or placing heavy items on kitchen bench surfaces is strictly prohibited.
  2. Smoking and vaping are prohibited on the premises.
  3. The Licensee must comply with all safety and operational guidelines provided by VIVE.
  4. All requests for modifications to the venue setup must be approved in writing by VIVE.
  5. The Venue Hire Contract must be signed and returned upon the deposit payment.

4. Gift Card (e-gift card)

Usage and Redemption

  1. Valid Purchases:
    • Gift Cards and e-Gift Cards can be redeemed online at VIVE Cooking School for cooking classes or products, excluding other gift cards and private events.
    • Gift Cards and e-Gift Cards cannot be redeemed for cash.
  2. Lost or Stolen Cards:
    • Gift Cards and e-Gift Cards are equivalent to cash. VIVE is not responsible for lost or stolen cards, and replacements will not be issued.
  3. Non-Refundable and Non-Exchangeable:
    • Gift Cards and e-Gift Cards are non-refundable and cannot be exchanged for other services or products.

Expiry and Extensions

  1. Expiry Date:
    • All Gift Cards and e-Gift Cards are valid for 3 years from the date of issue. They must be redeemed on or before the expiry date.
  2. Post-Expiry:
    • Expired Gift Cards and e-Gift Cards are non-refundable in whole or in part. Any remaining balance on expired cards becomes the property of VIVE Cooking School.
    • Expired Gift Cards and e-Gift Cards cannot be used for any transactions, and all attempts to redeem them will be declined.
  3. Extensions:
    • If a Gift Card or e-Gift Card has expired within 6 months of the expiry date, an extension of 6 months can be requested.
    • A $35 extension fee per card applies at the time of the extension.
    • Extensions are granted once per card and cannot be applied to cards expired for more than 6 months
  4. Extension Requests:
    • Eligible customers may request an extension by contacting our Customer Service team via email at order@vivecookingschool.theteamserver.com

General Term

  1. VIVE Cooking School reserves the right to modify or discontinue services associated with Gift Cards and e-Gift Cards without prior notice.
  2. Gift Cards and e-Gift Cards are bound by these Terms & Conditions, and the purchase or use of a card constitutes acceptance of these terms.

5. E-commerce Products (shipping, return)

At VIVE Cooking School, we are committed to providing our valued customers with high-quality cookware and kitchenware. We understand that occasionally, you may need to return a product. This Returns Policy outlines the terms and conditions of our return process to ensure a smooth and hassle-free experience.
